Introduction; Consent to Terms
Please read these Terms of Use before using kpcr.org or any of its features, including, but not limited to, KPCR archives and KPCR podcasts (collectively, the "KPCR Web sites" or the "Service"). By using the Service, you agree to be bound by these terms. If you do not agree to these terms, please exit the Service. We reserve the right, at our discretion, to modify, add, or delete portions of these terms at any time by posting updated terms on the KPCR web sites. Please check these terms frequently for updates. Any modifications, additions, or deletions to these terms shall be effective immediately upon posting of updated terms. Your continued use of the Service following the posting of updated terms means you agree to those changes.
Copyrights
The contents of KPCR web sites are protected by U.S. and international copyright laws. You may not reproduce, distribute, transmit, display, prepare derivative works, or perform any copyrighted material on KPCR web sites without their prior written consent, except as provided below. You may copy and print a limited amount of content, and you may download KPCR podcast content, for your personal, non-commercial use only, provided that you include all copyright and other notices contained in the content and that you do not modify the content. Trademarks
KPCR®, Pirate Cat Radio, and KPCR program names are service marks of the Central Coast Media Education Foundation or the producers of the programs. All rights reserved. You may not use any KPCR service marks, logos, or graphics without KPCR's prior written consent.
Framing
KPCR does not allow framing of its web sites.
Links to KPCR Web Sites
KPCR encourages and permits links to content on KPCR web sites. However, KPCR is an organization committed to the highest journalistic ethics and standards and to independent, noncommercial journalism, both in fact and appearance. Therefore, the linking should not (a) suggest that KPCR promotes or endorses any third party's causes, ideas, web sites, products or services, or (b) use KPCR content for inappropriate commercial purposes. We reserve the right to withdraw permission for any link.
Links to Third Party Sites
KPCR has provided links to internet sites maintained by third parties, over which KPCR has no control. KPCR does not endorse the content, operators, products or services of such sites, and is not responsible or liable for the content, operators, availability, accuracy, quality, advertising, products, services, or other materials on or available from such sites. KPCR shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, products or services available on or through such sites.
KPCR Podcasts
KPCR provides podcasts (the "KPCR Podcasts") consisting of selected audio content from KPCR and other providers, made available over the internet using an XML feed and an associated audio file that may be downloaded and played from a user's computer or transferred to a portable listening device. KPCR podcasts are protected by U.S. and international copyright laws. All rights in and to the KPCR podcasts are reserved to KPCR or the content provider. KPCR podcasts are available for personal, noncommercial use only. You may download, copy and/or transfer to a portable listening device the KPCR podcasts for your personal, noncommercial use only, provided that you do not modify the content. You also may link to KPCR podcasts from your web site, weblog or similar application, as long as the linking does not (a) suggest that KPCR promotes or endorses any third party's causes, ideas, web sites, products or services, or (b) use KPCR content for inappropriate commercial purposes. KPCR reserves the right to discontinue providing KPCR podcasts and to require that you cease accessing or using the KPCR podcasts, or any content contained in the KPCR podcasts, at any time for any reason.
Use of the Service
If you use the Service, by submission of essays, e-mails or other information via kpcr.org, you must follow a few simple rules:
- While we do not seek to limit expression of ideas, certain materials and language will not be tolerated. You may not post, upload or transmit any material or links to material that is libelous, defamatory, false, obscene, indecent, lewd, pornographic, violent, abusive, threatening, harassing, discriminatory, in violation of the law or that constitutes hate speech.
- You may only post, upload or transmit materials for which you have the copyright or other permission to distribute electronically. You may not violate, plagiarize, or infringe on the rights of third parties, including copyright, trademark, trade secret, privacy, personal, publicity, moral or proprietary rights. You promise and represent that any posted, uploaded, included or transmitted materials will be owned by you or in the public domain.
- The Service can only be used for noncommercial purposes. You cannot distribute or otherwise publish any material containing any solicitation of funds, advertising or solicitation for goods and services.
- You may not post, upload or transmit any software or other material which contains a virus or other harmful code or device. You may not use the Service to distribute chain letters, mass mailings or "spam" or to gather e-mail addresses for the purpose of sending "spam" to other users of the Service.
- By posting, uploading or transmitting any material on or through the Service, you hereby grant KPCR a non-exclusive, perpetual, royalty-free, worldwide license to use, copy, sublicense, modify, transmit, publicly perform or display that material, and your name and location (city, state and/or country), if you provide that information to us, in connection with that material, in all media, whether or not now known.
- Persons under the age of eighteen (18) must obtain parental permission before registering, uploading or transmitting material on or through the Service.
Rules & Guidelines for Submitting Comments on kpcr.org
KPCR allows users to submit comments anonymously or, in certain instances, with registration. Any information collected by KPCR when requiring registration will be stored and used per KPCR's Privacy Policy.
Recurring Donations and Authorization
When you make a recurring donation to KPCR, you authorize KPCR to charge your selected payment method on a recurring basis for the donation amount and frequency you choose (for example, monthly), until you cancel.
Before completing your donation, you are shown the donation amount, billing frequency, and clear notice that the donation will recur automatically unless cancelled. By submitting your payment information, you confirm that you understand and agree to these recurring charges.
You will receive confirmation of your recurring donation after your payment is processed.
Ongoing Authorization and Prior Charges
By maintaining an active recurring donation, you acknowledge that each recurring charge is authorized pursuant to the authorization you provided at the time of sign-up, unless and until you cancel your recurring donation.
Recurring donations may result in multiple charges over time, which may appear on your payment statement using KPCR's billing descriptor.
Cancellation
You may cancel your recurring donation at any time and without penalty. Once canceled, no future donation charges will be processed.
To avoid being charged for an upcoming billing period, cancellation requests must be submitted before the next scheduled donation date. Donations processed prior to cancellation are not refundable, except as required by law or as otherwise expressly stated by KPCR.
KPCR provides clear and accessible methods for canceling a recurring donation:
- Email info@kpcr.org to request a cancellation.
- Call the KPCR office at 408-357-0330.
Disclaimer of Warranties; Limitation of Liability
The Service and its content are provided "as is" without warranties of any kind, express or implied. KPCR does not warrant that the Service will be uninterrupted or error-free. To the fullest extent permitted by law, KPCR shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service.
Governing Law
These terms are governed by the laws of the State of California, without regard to its conflict of law principles.
